What the Law Requires of Farnham Landlords

If you let a property in Farnham, the roof is your responsibility in law — and that duty cannot be signed away in the tenancy agreement. Three pieces of legislation matter, and it is worth understanding what each one actually requires.

Landlord and Tenant Act 1985, Section 11. This is the foundation. It obliges the landlord to keep in repair the structure and exterior of the dwelling — which expressly includes the roof, gutters and external pipes. The tenant cannot be made responsible for these under a standard assured tenancy, however the agreement is worded. If a tenant reports a leak, the clock on your repairing obligation starts the moment you are made aware.

Homes (Fitness for Human Habitation) Act 2018. This strengthened tenants’ hand considerably. It requires rented homes to be fit for human habitation throughout the tenancy, and — crucially — lets a tenant take the landlord to court directly if they fail to keep it so. A roof leak causing damp, mould or water ingress can render a property unfit under this Act. The tenant does not need to wait for the council; they can act themselves.

Awaab’s Law and the Renters’ Rights Act 2025. Here accuracy matters, because there is a lot of loose commentary. Awaab’s Law introduced fixed statutory timescales for investigating and fixing damp and mould — but as of 2026 it applies only to social housing, in force since October 2025. The Renters’ Rights Act 2025 (whose main tenancy reforms commenced on 1 May 2026) contains the legal power to extend Awaab’s Law to private landlords, but no commencement date has been set for that extension; it sits in a later phase of the roadmap, subject to consultation. So a Farnham private landlord is not yet bound by Awaab’s fixed timescales — but is very much bound by the 1985 and 2018 Acts today, and the direction of travel is clear. Acting promptly on reported leaks is both good practice now and preparation for what is coming.
